End User License Agreement
Version 1.0 · Effective Date: June 24, 2026
1. The Agreement
This End User License Agreement (the “Agreement”) is a binding contract between you (the
“Licensee” or “you”) and Christopher Pescatore, D.M.D. (the “Developer,” “we,” or “us”)
governing your use of the Digital Dental Sculptor™ Suite (the “Suite” or the “Software”).
The Suite is delivered as a single product bundle consisting of the following components:
• Digital Dental Sculptor™ add-on for Blender (the “DDS add-on”)
• Pescatore Tooth Library™ (the proprietary anatomical tooth library)
• Dental Viewport OSC™ overlay add-on for Blender (the “OSC overlay”)
• DDS Master File (the Blender scene file that contains the Pescatore Tooth Library™
and the pre-configured DDS collections)
together with any associated documentation, updates, sample files, and digital materials.
References in this Agreement to the “Software” or the “Suite” mean all four components and
accompanying materials collectively, unless a specific component is named.
By installing any component of the Suite, by checking the box indicating your acceptance of
these terms at the time of purchase, or by using any component of the Suite in any way, you
agree to be bound by this Agreement. If you do not agree, do not install or use the Suite.
2. Definitions
• “Suite” means the Digital Dental Sculptor™ Suite, comprising the four components
listed in Section 1 together with all associated documentation, updates, and digital
materials.
• “Software” is used interchangeably with “Suite” in this Agreement.
• “Practice” means the single dental practice, office, or laboratory belonging to or
employing the purchasing dentist or owner.
• “Authorized Computer” means a computer located at the Practice and used by the
Licensee or the Licensee’s employees in the ordinary course of the Practice’s clinical
work.
• “License Key” means the unique alphanumeric identifier issued to you at the time of
purchase that enables the Suite to operate.

• “Master File” means the DDS Master File Blender scene (DDS_Master_File.blend) and
any duplicate or derivative of it created by you for individual patient cases.
3. License Grant
Subject to your full and continuing compliance with this Agreement and your payment of all
applicable fees, the Developer grants you a non-exclusive, non-transferable, revocable license
to install and use the Suite on up to three (3) Authorized Computers within a single Practice, for
your own internal clinical, educational, and case-design use.
The license covers all four components of the Suite together. You may not separate,
redistribute, or sell any individual component of the Suite, and your right to use any one
component is contingent on your continuing compliance with this Agreement as it applies to the
Suite as a whole.
This is a license, not a sale. The Developer retains all right, title, and interest in the Suite,
including all intellectual property rights in each component.
4. Permitted Use
Within the scope of the license granted in Section 3, you may:
• Install and use the Suite on up to three Authorized Computers within your Practice.
• Create unlimited patient case files using the Master File as a template, and store, share,
and deliver those patient-specific case files (or files exported from them) to your patients,
your laboratory, your 3D printer, your milling unit, or any other downstream party as
required to perform clinical work.
• Make backup copies of the Suite for archival purposes only.
• Use the included Pescatore Tooth Library™ teeth as components of patient-specific
wax-ups, restorations, models, and case files produced in the course of your own clinical
practice.
5. Restrictions
Except as expressly permitted by this Agreement or by applicable law that cannot be waived by
contract, you will not:
• Distribute, share, resell, rent, lease, sublicense, or otherwise transfer the Suite, any
component of the Suite, the Master File, the Pescatore Tooth Library™, or your License
Key to any third party, whether for compensation or free of charge.
• Publish, upload, or otherwise make any component of the Suite available on any
website, file-sharing platform, asset library, training course, or other distribution channel.
• Extract, repackage, redistribute, or use the Pescatore Tooth Library™ teeth as
standalone assets, asset packs, training materials, sample files, or content for any
product or service other than your own clinical patient cases.

• Modify, decompile, reverse engineer, or attempt to derive the source design, algorithms,
or proprietary geometry of the Pescatore Tooth Library™ or any other component of the
Suite.
• Remove, alter, or obscure any copyright notice, trademark, watermark, license-key
validation, or other proprietary marking embedded in or accompanying the Suite.
• Use the Suite in any manner that violates applicable law, infringes the rights of others, or
jeopardizes patient safety.
6. License Keys and Activation
Your purchase entitles you to one License Key, which unlocks the entire Suite. The DDS add-on
and the OSC overlay validate this key periodically through an online check with the Developer’s
licensing service. The Suite requires a working License Key to operate. You agree:
• Not to share, publish, or disclose your License Key to any party outside your Practice.
• Not to attempt to bypass, disable, or interfere with the license-validation check or any
other technical protection measure in the Suite.
• That the Developer may, at the Developer’s discretion, deactivate any License Key that
has been refunded, has been shared outside the Practice, or has otherwise been used
in breach of this Agreement.
If your License Key is deactivated, the Suite will cease to function on the next online check.
Continued use of any component of the Suite, including the Master File and the Pescatore
Tooth Library™, after deactivation is a breach of this Agreement.
7. Updates and Future Versions
Your purchase includes lifetime use of Version 1 of the Suite, plus every future update we
release within Version 1 — including bug fixes, new Blender-version compatibility, and any new
features added to Version 1 — at no additional cost. Updates apply to all components of the
Suite collectively.
A future Version 2 (or any subsequent major version) would be a separate product release.
Whether your existing license entitles you to that release, in whole or in part, will be at the
Developer’s discretion and communicated at the time of release.
The Developer is under no obligation to release any specific update, fix any specific defect, or
maintain compatibility with any specific version of Blender or any specific operating system.
8. Refunds
The Developer offers a fourteen (14) day money-back guarantee from the date of purchase. To
request a refund, contact the Developer at the email address provided with your purchase
confirmation within the fourteen-day window and state that you wish to be refunded under this
Agreement.

Upon refund:
• Your License Key will be deactivated. The Suite will cease to function on its next online
check.
• Your right to use the Suite, any component of the Suite, the Master File, the Pescatore
Tooth Library™, and any associated materials terminates immediately.
• You agree to uninstall the Suite from all Authorized Computers and to delete any copies
of the Master File, the Pescatore Tooth Library™, the DDS add-on, the OSC overlay,
and any case files containing geometry derived from the Pescatore Tooth Library™
within seven (7) days of the refund.
Continued use of any component of the Suite, or any files derived from the Pescatore Tooth
Library™, after a refund is a material breach of this Agreement and may give rise to claims for
damages, injunctive relief, or both.
Refunds are not available after the fourteen-day window has expired. Partial refunds for
individual components of the Suite are not offered; the Suite is sold as a single bundled product.
9. Watermarking and Traceability
You acknowledge and agree that the Master File and other digital materials delivered to you as
part of the Suite contain identifying information (a “watermark”) tying those files to your
purchase. The watermark may be embedded in custom metadata, scene properties, or other
locations within the file.
The watermark is used solely for the Developer’s legitimate interest in detecting and addressing
unauthorized distribution of the Suite. It does not contain patient information and is not
transmitted to any third party in the ordinary course of your use of the Suite.
You agree not to remove, alter, or attempt to obscure the watermark.
10. The Pescatore Tooth Library™
The Pescatore Tooth Library™ is the original copyrighted work of Christopher Pescatore,
D.M.D., representing significant authoring effort, and is the highest-value component of the
Suite. The teeth contained in the library are licensed to you only as components used inside
patient-specific case files produced in the course of your clinical practice.
Without limiting Section 5, you specifically may not extract, redistribute, resell, or use the
Pescatore Tooth Library™ teeth as standalone assets, in asset packs, in training courses, in
promotional materials, or in any product or service other than your own clinical patient cases.
11. Patient Safety and Clinical Responsibility
The Suite is a design tool. It is not a medical device, a diagnostic instrument, or a substitute for
the professional judgment of a licensed dentist, orthodontist, prosthodontist, dental laboratory,
or other qualified clinician.

All clinical decisions — including but not limited to case selection, tooth position, occlusal
scheme, restoration design, fit, and final delivery to the patient — are the sole responsibility of
the licensed clinician using the Suite. The Developer makes no representation that the Suite is
suitable for any particular patient, case type, anatomical configuration, or clinical outcome.
You agree that you are solely responsible for verifying the accuracy of any wax-up, model, or
restoration produced using the Suite before delivering or using it in patient care, and for
complying with all laws, regulations, professional standards, and informed-consent requirements
applicable to your practice.
12. Disclaimer of Warranties
THE SUITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND
WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR
IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-
INFRINGEMENT.
Without limiting the foregoing, the Developer does not warrant that the Suite will be
uninterrupted, error-free, free from defects, or that any defects will be corrected. The Developer
does not warrant that the Suite will be compatible with any specific version of Blender, any
specific operating system, or any specific hardware configuration.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE
DEVELOPER BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR
FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR PATIENT
CASES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE
SUITE, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES.
IN ANY EVENT, THE DEVELOPER’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF
OR RELATED TO THIS AGREEMENT WILL NOT EXCEED THE TOTAL AMOUNT YOU
PAID TO THE DEVELOPER FOR THE SUITE IN THE TWELVE (12) MONTHS IMMEDIATELY
PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
14. Term and Termination
This Agreement is effective on the date you first install, activate, or accept the terms of any
component of the Suite, and continues unless terminated earlier as provided in this Section.
This Agreement will terminate automatically and immediately upon:

• Your material breach of any provision of this Agreement;
• Your refund of the Suite under Section 8; or
• Notice from the Developer that the Agreement is terminated for any reason permitted by
applicable law.
Upon termination, your right to use the Suite (including every component) terminates, your
License Key may be deactivated by the Developer, and you must uninstall the Suite and delete
the Master File, the Pescatore Tooth Library™, and any files containing geometry derived from
the Pescatore Tooth Library™ within seven (7) days.
15. Survival
Sections 5 (Restrictions), 9 (Watermarking), 10 (Pescatore Tooth Library™), 12 (Disclaimer of
Warranties), 13 (Limitation of Liability), 14 (Termination), 15 (Survival), 16 (Governing Law), and
any other provision that by its nature is intended to survive will continue in full force after
termination of this Agreement.
16. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of California, United States, without
regard to its conflict-of-laws principles. Any dispute arising out of or related to this Agreement
will be brought exclusively in the state or federal courts located in Alameda County, and you
and the Developer each consent to the personal jurisdiction of those courts.
17. General
Entire Agreement
This Agreement, together with any policies referenced in it and any order or purchase
confirmation, is the entire agreement between you and the Developer regarding the Suite, and
supersedes all prior or contemporaneous communications, proposals, and representations
regarding the Suite.
Severability
If any provision of this Agreement is held by a court of competent jurisdiction to be
unenforceable, the remaining provisions will continue in full force and effect, and the
unenforceable provision will be modified only to the minimum extent necessary to make it
enforceable.
Assignment
You may not assign or transfer this Agreement or any of your rights under it without the
Developer’s prior written consent. The Developer may assign this Agreement at any time. Any
attempted assignment in violation of this Section is void.

Notices
Notices to the Developer must be sent to the email address provided with your purchase
confirmation. Notices to you may be sent to the email address associated with your purchase.
No Waiver
The Developer’s failure to enforce any right or provision of this Agreement is not a waiver of that
right or provision. No waiver of any term is effective unless in writing and signed by the
Developer.
18. Acceptance
By checking the box indicating your acceptance of these terms at the time of purchase, by
installing any component of the Suite, or by using any component of the Suite in any way, you
acknowledge that you have read, understood, and agree to be bound by this Agreement.
